Breamlea, Victoria
Breamlea1
Very quiet and reclusive
Breamlea is a small enclave between Torquay and Barwon Heads in Victoria.
There is just one road in, not many houses, a caravan park and a store.
I have been told that George Pell often visited there in the 1980's with some company.
Does anyone know of the catholic church owning any property there in the past?

And so this is christmas and what have you done...
Arriving today the fence was naked.
The 3rd. fence ribbons had been removed. When, why and who by is unknown.

Christmas being a time of joy, peace and love we parked our camels but finding the gates to the manger locked our gift of many coloured ribbons was tied upon the fence.

By pure chance a gentleman walked past and struck up a conversation.
He was a student at Xavier College around 1960 and remembers Eldon Hogan well. He confirmed that Eldon Hogan was a paedophile and said three students at that time provided a statutory declaration to the school about Eldon Hogan's sexual abuse of students.

This man knew of a sexual abuse event on another student by Eldon Hogan at a cadet camp. (a different event to the known one in Eldon's biography).
♦ Eldon Hogan bio.

He also cleared up a mystery about Hogan's money. Hogan's aunt was the well know radio and TV personality Martha Gardner and she left her money to Eldon.
Martha Gardener is the nom de plume used by Kathleen Zoe Worrall (née Norris).

The question now is will the ribbons remain or will Xavier College again insult sex abuse survivors and rip them down.

Allowing a public acknowledgement of the history of sex abuse at the school seems beyond them.

There are three people who could order the removal of the ribbons.

Immaculate Conception Church, Hawthorn
Hawthorn Catholic Parish, under the care of the Jesuits, is a vibrant, welcoming and faith-filled presence in Hawthorn with a history dating back to the 1860’s.

Our two churches are Immaculate Conception (ICC) on Burwood Road and St. Joseph’s on Denham St

Our Parish Priest Fr Des Dwyer SJ is assisted by Fr Peter L’Estrange SJ and Fr Paul Horan SJ.

♦ The Age story - Nightmare at Xavier College: New claims of abuse, ritual humiliation

A member of the Xavier Abuse Survivors group put up some ribbons on the Immaculate Conception church fence on the same day Xavier College was given their third Loud Fence.
These were ripped off very quickly by the jesuit priests there.

The member reports:
The second lot of ribbons tied to the front gates of the Immaculate Conception Church in Hawthorn were also taken down with undue haste by the Jesuits ( there were Jesuits peering around the corners of the Church watching me put them up )

So here then are some photos of the third lot of ribbons put up at The Immaculate Conception Church in Hawthorn -
to draw attention to the significant and un-acknowledged level of childhood sexual abuse overseen by Jesuits such as Celso Rominem who have had connections to both Xavier College and the Church of the Immaculate Conception.

I placed the ribbons this time - on the side enterence because I could see that the front gates needed to be opened for funerals etc ...
and that the ribbons might have a better chance of surviving for awhile if they were around the side

International Loud Fence Day.
Saturday November 20, 2021.
Message from LOUD fence Inc.
Every ribbon has a voice - just listen! On November 20th we aim to have ribbons tied at various locations around the globe to show support for survivors and victims of child sexual assault.

We hope organisations and institutions will join with community members to acknowledge past crimes and declare that they will no longer allow children to be hurt or silenced.

Please let us know where you will be and at what time so others can join you. We would love you to share any photos from your location. Thank you, LOUD fence Inc.

Xavier College Loud Fence Nov. 20, 2021
Update:
As at Monday December 6, 2021, the ribbons were still in place.
Is this a policy shift by the school?

A small group of Xavier College abuse survivors and supporters met at the Barkers Rd. entrance around 11am.
Ribbons were in short supply, my order from a supplier had not arrived in the mail.

It was very quiet, the front gate was locked, there was no sport being played on the ovals.
No sign of any Xavier staff.

We tied on the ribbons, mulled around and had some general chat.
This is our humble offering to Xavier College to help them "own the past".
Will it remain? Or will they be ripped off again?

The third photo shows the remains of the previous Loud Fence which was deemed a "danger to the public".

It was interesting to note that survivors meeting at the location where abuse happened does really stimulate discussion and the telling of memories.
Much more so, I think, than at some neutral location.

I had a thought before that there should be a Survivors Day at the school.
An annual day of remembrance and a show of contrition by the school and the Society of Jesus.

This is the effective message Xavier College sends to abuse survivors.

Contrast with The Geelong College
Loud Fence
On Saturday 3 March 2018 the College acknowledged harm at The Geelong College at a Loud Fence Installation Ceremony.
Some senior students with the support of the College, started a Loud Fence outside the Chapel on the corner of Aphrasia and Talbot Streets.

After the ribbons had been displayed for a number of months it was decided to create a permanent installation with the ribbons to be housed in the Chapel as a reminder of those affected by harm in our school.

Help and Support
• Independent Facilitator: The College appointed an Independent Facilitator to help support survivors of harm at our school in 2015.
• Direct to the School: The Geelong College Principal, Dr Peter Miller is available to assist survivors directly.
• The Reach Out Committee of The Geelong College Council oversees the support for survivors of historical abuse for the College.
The committee is comprised of the College Council Chair, the Principal, the President of the OGCA, two other College Council Members and another member of our community with professional experience and skills relevant to this important group.

You see here that the school is deeply involved i.e. taking responsibility, in assisting abuse survivors.
By contrast Xavier College tells survivors to go see In Good faith Foundation in Brunswick.

The policy of Xavier College and the Old Xaverians Association is to redirect survivors so they never bring their stories into the school grounds.
They have contact persons for current complaints but nothing (deliberately) for historical complaints.
Two emails to a contact person were not even answered.

And ,of course, its completely acceptable to give students prizes financed by a sex abuser and with his name on the prize. October 18, 2021
Vatican City — An adult survivor of abuse by a priest appealed to the world's seminarians to become good priests and to make sure the "bitter truth" always prevails, not silence about scandals and their cover-up.

"Please, do not sweep things under the carpet, because then they start to stink, putrefy, and the rug itself will rot away. ...
Let us realize that if we hide these facts, when we keep our mouths shut, we hide the filth and we thus become a collaborator," said the survivor in a letter sent to Pope Francis and addressed to all seminarians.

Tasmanian Education Department shielded paedophiles, disbelieved students, inquiry finds
November 9, 2021
The Tasmanian Education Department's predominant response to child sexual abuse complaints has for decades been to ignore students, shield abusers and protect itself from legal, financial and reputational risks, an inquiry has found.
Key points:

Tasmania's Education Department spent decades shielding child sexual abusers and protecting itself from reputational risk, an inquiry has found
The inquiry found "very recent" examples of student concerns and complaints that have been assumed to be untrue
Investigators unable to say whether the incidence of sexual abuse in Tasmanian government schools has declined, increased or remained stable over the last five or six decades

The Tasmanian government has released the findings and recommendations from an independent inquiry into responses to child sexual abuse in government schools announced last August, prior to a commission of inquiry being established.

It was conducted by professors Stephen Smallbone and Tim McCormack, who made 21 recommendations, which the government has fully accepted.
comment: Professor Stephen Smallbone is also a member of the Society of Jesus Consultative Panel.
The Tasmanian inquiry found the DoE response was "to ignore students, shield abusers and protect itself from legal, financial and reputational risks " which is exactly the same as the Society of Jesus' past responses.

Stephen_Smallbone

This website emailed Professor Smallbone on Nov. 11, 2021 asking about Recommendation 1,
"Will you recommend to the Society of Jesus that they also do the same?"
We have not not received a reply.
The Recommendations
Recommendation 1: Safeguarding Records
" There is an urgent need for complete and analysable records of all sexual abuse concerns,
including substantiated and unsubstantiated incidents and episodes, and all types of abuse (e.g.
teacher-student; student-student; online abuse).

A database established to capture this
information should be able to produce quantitative (averages; ranges etc) and qualitative data on,
for example: types of abuse; when and where incidents occurred; how incidents first came to light;
the time between incidents occurring and complaints being made; ages of complainants and
respondents; outcomes for complainants and alleged abusers; and the outcomes of any system
reviews following the resolution of complaints."

1. We recommend that all sexual abuse concerns, complaints, responses and outcomes be systematically recorded by the Department of Education, and that these records are periodically analysed to monitor patterns and trends.

20. We recommend that the Department of Education review its complaints and grievances procedures and processes so as to improve access by students, their parents, or other concerned persons

Tasmanian health department put interests of alleged pedophile James Griffin ahead of victims, Ombudsman says
December 10, 2021.
Tasmania's Ombudsman has accused the state's health department of putting the interests of an alleged paedophile nurse ahead of his victims in a scathing review into its response to requests for information.
..the department has argued it would be against the public interest to release details of complaints against Griffin ..

the department claimed none of the documents could be released, citing privacy issues, concern for the mental health of Griffin's friends, family and former colleagues, and fears publicising such information could deter people from making similar reports in the future.

I am concerned that it does not appear to have considered the interests of the victims of Mr Griffin's alleged offending..
"I consider that the public interest in protecting the interests of alleged sexual abusers of children is lower than that of the victims of such abuse."

"As distressing as this process has been, it's offered an invaluable insight into the contempt with which the system treats the public," ( freelance journalist Camille Bianchi )

Papal commission looks at role, rights of alleged victims in abuse trials
Dec 15, 2021
ROME — The Pontifical Commission for the Protection of Minors hosted a three-day seminar looking at the rights in church trials of those alleging they suffered sexual abuse as children.
The need to better understand and promote the rights of alleged victims in the context of the church’s canonical proceedings had been one of several topics discussed during a seminar

Archbishop Charles J. Scicluna said more could be done in supporting the rights of victims.

Pope Francis’ “Vos Estis Lux Mundi” in 2019 provides for the first time “a universal law that states that the victim has a right to be advised of the outcome of the investigation” concerning crimes allegedly committed by people in leadership,he wrote.

But “I would suggest that we also use this law by analogy for all other situations” by giving the same right to victims of people who are not just leaders but are members of the clergy or of religious orders, he wrote.

The archbishop had flagged the problem during a Vatican summit on abuse in February 2019 when he noted there needed to be a clearer policy on keeping victims informed of the status of cases against their abusers.
“Many victims are hurt by the fact that they do not receive the final report,” he had said. “It’s a lack of respect.”

another suggestion he put forward at the December 2019 seminar was to appoint “a safeguarding officer or other
suitable person that keeps contact with the victim and informs the victim of the progress of the procedures,”

including the outcomes of investigations, trials or extrajudicial processes, especially now that the “pontifical secret” has been removed.

There should be a “procurator for the person aggrieved,” that is, a person designated to represent the victim
in the church’s penal processes and share information with the victim, he had said.

"Denial of natural justice" excuse by the Society of Jesus
The Tasmanian story opposite highlights the refusal of the Society of Jesus and Xavier College to publish the names of credibly accused child sex abusers.

The excuse has been its a denial of natural justice combined with they are "unproven allegations".
"Unproven" means the abuser has not been convicted in court.
Reports of abuse directly from the survivors is not enough for them to publicly accept these abusers were abusers.

The interests of the survivors carries no weight.

Denying these criminals were criminals is continuing to abuse the survivors.

The Rights of the Survivors
Of the 35 Claims of Child Sexual Abuse Reported from 1 July 2018 to 31 December 2020 reported by the Society of Jesus only one was independantly investigated.

The Society of Jesus has never disclosed how they investigate a claim of abuse or under what circumstances they would do it. From the above, obviously it it rare.

This is a denial of "natural justice" for the survivor when you compare it to any public company who would internally investigate ALL complaints of sexual assault, because that is now the norm in our society.

The Society of Jesus has no interest in rooting out the criminals in their midst.
In fact they do everything they can to defend against allegations of abuse and protect the perpetrator.
In effect they are condoning criminal sexual abuse by their priests.

There are three types of complaint.
1. Direct to the Society of Jesus' office of professional standards.
2. A civil suit.
3. A police report.

In number 1, do they investigate the complaint?
In number 2, the survivors lawyers can ask for disclosure, but how hard does the Society of Jesus actually look?.
In number 3, if the police execute a search warrant what are they given access to and able to find ?

This situation is haunted by the Marilyn Warren report when, after Brian McCoy SJ said "all the available files had been inspected and there was no indication that Victor Higgs SJ was moved because of a sex abuse complaint", then Ms. Warren, with her legal skills and archives access found quite the opposite to McCoy's deceitful statement.

There is only one solution, that is to have a truly independant investigator with complete archives access who will investigate EVERY sex abuse complaint, and make the findings available to the complainant.

If this doesn't happen the cover up of historical sex abuse will continue as strong as ever.

UK Clerical sex abuse survivor wins payout for being 'retraumatised'
18 October 2021
The claim was made against the Roman Catholic Archdiocese of Westminster, not against Cardinal Nichols.
A survivor of sexual abuse by a priest who was branded “needy” and “manipulative” by church safeguarding officials has been awarded a financial settlement after seeking redress for the trauma caused by the Church’s handling of her case.

She received compensation from the Church for the abuse. But she decided to go ahead and make a further claim after the additional distress caused by the way in she was treated by Westminster diocese when she made inquiries regarding her case.

This latest settlement is believed to be the first of its kind and may well pave the way for similar cases to be brought against the Church by abuse survivors.
comment: Since the Archdiocese made a settlement they must have had legal advice that the survivor had a good case and was likely to win in court.
This is a legal warning to church entities that their poor response can lead to further financial and reputational loss to themselves.
Does Australian law allow this?

boy_crying2
Retraumatising
this can be:
• Fighting dirty against a compensation claim.
• Minimising claims by denials viz. Theo Overberg's offences.
• Refusing to communicate with a survivor.
• Discrediting the survivor.
• Threatening to sue the survivor.
• Ripping down Loud Fences.
• Lying. Saying one thing and doing the opposite.
• Treating a survivor as the enemy.
e.g. My lawyers have advised me to be very careful about what I say and do because the Jesuit lawyers will use it against me.
• Attempting to block sex abuse facts being disseminated.
• Denying archive information to survivors.
These are the behaviours of Xavier College and the Society of Jesus.

Jesuit Superior General Fr. Arturo Sosa SJ said.
"The protection and security of vulnerable people is the yardstick by which we can measure how close we are to the goal of the reconciliation of all things in Christ,"

German Jesuit Fr. Hans Zollner SJ, director of the Pontifical Gregorian University’s Institute of Anthropology: Interdisciplinary Studies on Human Dignity and Care, said their work will help "deepen our understanding of how these crippling wounds came about."
"All humans deserve to be treated with dignity,"

Baroness Sheila Hollins, a professor emeritus of psychiatry of intellectual disability at St. George's University of London, echoed those sentiments, saying that "there's a global call for accountability and transparency."

Discernment, Deep Listening and the Holy Spirit
Listening to the Spirit at the Plenary Council
Oct 11, 2021. What I took away from the Plenary Council was that all the members were very honest and open in listening to one another with a deep trust in discerning how the Holy Spirit was at work throughout the week.

We were open to the guidance of the Holy Spirit from the start and the Spirit led us to the end.

The whole week was a spiritual journey for me. I am grateful to the Plenary Council for the insightfulness and depth in the sharing;
for the wisdom imparted by members and the respect we had for each other in our great diversity;
for the sharing of rich spiritual experiences and the wonderful spiritual journey of the week.

This was God working through each of us. The spiritual conversation enabled us to reach a consensus each day and achieve communal discernment together.

It was a blessed week for me....

The Plenary Council has been a masterclass in avoiding the real problems in the Catholic Church.
Oct 11, 2021. Despite Brisbane archbishop Mark Coleridge telling us some months ago that “We [bishops] can’t put up a sign saying business as usual,” last week the Plenary Council organisers managed to get the 278 members participating in a process that guaranteed just that.

the Plenary Council organisers, either consciously or unconsciously, used the process to side-step the issues they wanted excluded.

One way they did this was by using a much-used word in Catholic circles these days, “discernment”. Another fashionable term the Plenary Council used is “deep listening” The Plenary Council used discernment and deep listening as smokescreens,....

Francis Sullivan says: “Confronting the shameful history of abuse is vital. That history is alive today. It is something we carry as a Church, and it must shape us as a Church. Unless all the implications of the sex abuse scandal are faced head-on, I fear the Church will struggle to be identified for anything else in my lifetime.”

The Guardian view on sexual abuse and the Catholic church: contrition is not enough Editorial
(a fairly bland editorial from The Guardian australia)
The French report is only the latest in a dismal, heart-rending sequence.
Last year, an investigation found that the Catholic church in England and Wales had failed to
adequately deal with sexual abuse perpetrated over decades by clergy and others associated with the church.

It had, the report’s authors stated, prioritised its own reputation over the welfare of abuse victims.
Other investigations have reached similarly damning conclusions in the United States, Ireland, Germany, Chile, Australia and Poland.
.......
The theology of the male priesthood has allowed flawed human beings to believe themselves to be above the law;
a corresponding culture of deference has too often made the church a safe space for abusers.
If a more healthy church is to emerge after this latest set of revelations, a cultural transformation, including greater openness, diversity and humility, is required.

The proof is in the pudding
Look at the actions not the words

• Sept. 26, 2021 NSW. Bid by Catholic church to stop child sexual abuse case rejected by NSW supreme court Church tried to stop a woman from suing, despite its own records showing it knew the priest was a paedophile

• Germany. German archbishop, Rainer Maria Cardinal Woelki and Archbishop Hesse of Hamburg both not reprimanded for covering up sex abuse.

• The society of Jesus Australia denying and minimizing Fr. Theo Overberg's sadistic sexualised punishment of boys.

• Xavier College still doing nothing to help sex abuse survivors.

“a profound and total, even cruel, indifference to the victims”
The independent commission into sexual abuse in the Catholic Church in France chaired by former judge Jean-Marc Sauve.
The French bishops commissioned the report in 2018 after abuse scandals

At least 330,000 people have been sexually abused in the Catholic Church in France since 1950
about 3,000 priests were aggressors

The former judge said the Church showed “a profound and total, even cruel, indifference to the victims” until about the year 2000. It then announced a policy of “zero tolerance” but did not effectively apply it.

“It’s a mistake to say the problem is behind us. No, the problem persists,” said Sauvé, who recently admitted he needed psychological help after hearing testimonies of some victims.

♦ www.pillarcatholic.com What the French abuse report says

Pope calls damning French report on abuse a ‘moment of shame’
Unfortunately , there were considerable numbers,” he said.
(he means unfortunate for the catholic church)

“I pray and we all pray together: to you, Lord, be the glory, to us the shame. This is a moment of shame ,” he said. (thank god its only a moment that will pass quickly)

he encouraged bishops, religious, and religious superiors “to continue making every effort so that similar dramas are not repeated.”
(its only a drama, he has used that description before. Dramas of course are not real, its not systemic criminal behaviour)

CRUELTY
Is it cruel to:
• Give a survivor a compensation payment and also deny the alleged perpetrator was a sex abuser?

• Rip down a loud fence twice and lie about the reasons.

• Use lawyers to deny and minimize sexual assaults and discredit the complainant?

• To deny that about 36 credibly accused sex abusers were sex abusers?

• Not even talk to a survivor about it when they disclose their abuse to you ( the school principal)?

• Not report child sexual assault to the authority when required by law?

• Not thoroughly investigate a sex abuse complaint and report the findings to the complainant?

• Accept large amounts of money for your school from a sex abuser's trust?

• To do nothing to help abuse survivors (Xavier College).

Such is the behaviour of Xavier College and the Society of Jesus.

Justice
Truth and transparency can only be achieved by a free flow of information.
By all parties wanting to achieve the same result.

The relevant parties (see diagram) should all be talking to each other and actively seeking the truth.
The survivor/complainant should receive compensation commensurate with current court awards.
The Independant Primary Contact Person working with a suitably experienced lawyer could recommend the amount to the Society of Jesus.

If the Society of Jesus accepts it then years of civil litigation, enormous legal costs and a lot of re-traumatising of the survivor will be avoided.
Conflict of interest must be avoided.
The Society of Jesus' Director of Professional Standards cannot be involved in determining the validity of the complaint or the amount of compensation. (which is what happens now if there not a civil suit).

Requirements:
• A change of heart is required from Xavier College and the Society of Jesus.
They must now adopt the attitude "yes, we want to know of any sex crimes comitted by jesuit priests or school staff."

• The Independant Primary Contact Person should be a trauma informed psychologist or psychiatrist.
• The Independant Investigators should be experienced in the field.
• The Independant Investigators must have access to all archives and school records.

“Always let your conscience be your guide”.
Of course, the principle, of the primacy of conscience – that is, one’s personal conscience as the ultimate guide in all our moral activity .

Such was clearly established by one of the Church’s greatest theologians, the Dominican St Thomas Aquinas.
He even proposed that an erroneous conscience was morally binding, provided one had made every possible effort to inform one’s conscience.
